2. Scope of Service & Computational Architecture

Oxivel provides an automated endurance sports intelligence software platform designed for runners, cyclists, and triathletes. The service computes deterministic mathematical models, including:

• Performance Management Chart (PMC) impulse-response telemetry: Chronic Training Load (CTL), Acute Training Load (ATL), and Training Stress Balance (TSB) with customizable time constants.
• Aerodynamic drag area ($CdA$) and rolling resistance pacing simulations across fluctuating gradients.
• Deterministic iso-osmolar carbohydrate oxidation and sweat sodium replenishment solvers.
• Adaptive density cockpits (Casual, Athlete, Pro Analyst) and autonomous 500m Home GPS Privacy Shielding.

The computational infrastructure is hosted in Google Cloud region europe-west3 (Frankfurt am Main, Germany). Platform access is delivered via standard web browsers and WebAssembly runtimes.

Binding Free-Tier Commitment: All core endurance telemetry analytics, PMC fitness metrics, fueling models, and workspace features on Oxivel are provided completely 100% Free Forever to registered athletes.

• Zero Subscriptions: There are no monthly or annual recurring fees, no mandatory trial periods, and no sudden paywalls locking previously free analytics.
• Zero Payment Data Solicitation: Oxivel does not collect, record, or process any credit card credentials, bank accounts, or billing addresses.
• Commercial Sustainability: The platform is funded through independent research resources and transparent, voluntary outbound merchant affiliate partnerships with verified sports equipment and endurance nutrition partners. Affiliate relationships never alter, bias, or prioritize mathematical calculations or physiological outputs.

Austrian Consumer Protection (KSchG) & Distance Selling (FAGG): Pursuant to the Austrian Distance and Off-Premises Selling Act (Fern- und Auswärtsgeschäfte-Gesetz — FAGG § 11) transposing EU Directive 2011/83/EU, consumers ordinarily possess a 14-day statutory right of withdrawal from distance service agreements.

Non-Medical Informational Nature: All computational outputs—including carbohydrate oxidation rates ($g/\text{hr}$), fluid and sweat sodium loss estimates ($mg/\text{hr}$), heart rate zone boundaries, lactate threshold estimations, and training stress scores—are mathematical simulations based on generalized physiological equations and user-supplied data.

Outputs do NOT constitute medical diagnosis, cardiovascular stress clearance, clinical dietetics, or therapeutic advice.

Mandatory Medical Clearance: Endurance athletics and high-intensity interval training place severe demands on the cardiovascular, metabolic, and musculoskeletal systems. Athletes must obtain clearance from a licensed sports physician or cardiologist before undertaking strenuous physical training.

Assumption of Risk: Athletes train outdoors and indoors entirely at their own risk. Oxivel does not monitor real-world traffic conditions, environmental heat hazards, road surfaces, or acute electrolyte imbalances.

6. Athlete Data Ownership & Portability (Art. 20 GDPR)

Athlete Data Sovereignty: You retain complete, unrestricted ownership of all uploaded workout recordings (FIT, TCX, GPX files), personal power/pace records, training logs, and biometric parameters. You maintain the right to export your entire activity corpus in open formats at any time pursuant to Article 20 GDPR.

Platform Intellectual Property: The software architecture, algorithmic implementations, user interface designs, and the Oxivel brand assets are the intellectual property of Păun Marius-Daniel, protected under the Austrian Copyright Act (Urheberrechtsgesetz — UrhG) and international treaties.

7. Acceptable Use & Operational Integrity

Athletes and automated systems shall not engage in:

• Automated web scraping, denial-of-service attacks, or vulnerability probing against Cloud Run and Cloud SQL endpoints.
• Credential stuffing, unauthorized reverse-engineering, or decompilation of API containers.
• Uploading corrupt, exploit-bearing, or malicious FIT/TCX files designed to cause buffer overflows or server crashes.

The operator reserves the right to suspend access for any user account engaging in abusive or malicious API conduct.

8. Limitation of Liability

Austrian Statutory Standard: The operator's liability is strictly limited to damages caused by intentional misconduct (Vorsatz) or gross negligence (grobe Fahrlässigkeit). Liability for slight negligence (leichte Fahrlässigkeit), indirect or consequential damages, lost profits, or data loss caused by athlete hardware failures is expressly excluded to the extent permitted by § 6 of the Austrian Consumer Protection Act (KSchG). Liability for bodily injury (Personenschäden) remains governed by mandatory statutory law.

9. Applicable Law & Judicial Venue

Governing Law: These Terms of Use shall be governed exclusively by the substantive laws of the Republic of Austria (Republik Österreich), excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

Judicial Venue: For disputes involving commercial entities or non-consumers, the exclusive place of jurisdiction shall be the competent court in Landesgericht Wiener Neustadt (or the competent Bezirksgericht Baden). For consumers residing within the European Union, statutory consumer jurisdictions pursuant to § 14 KSchG or Regulation (EU) No 1215/2012 apply.
